残念ながらその説明は正しくありません。
無効にする「決意を示す」のと「決定」は別です。

総会として「決定」をするには「決定」を決議する必要があります。具体的にはdecides（決定する）という文言とともに、決定事項がoperative paragraph（本文）に記載される必要があります。

ここを今回の表明で外務省は正しく「死文化したとの認識を規定した」「言及を削除するとの全加盟国首脳の決意を規定」と表現しており、「無効扱いを決定した」とは表現していませんし、そう捉えることはできないことへの自覚を示す表現に留めています。

国連の手続き上、安保理が承認するには総会の「決定」が必要です。しかし総会はこれを決定せず、特別委員会（Special Committee）での検討に最終判断を委ねました（Decides以後の文を参照）。本来なら、これが「決定」事項であれば、改正条項が「発動」され手続きが開始される筈でした。ところが、決議50/52号の「本文」にあったのは以下の文言のみです（この際ハイライトは無視してください）。

「（中略）将来に向けて効力を生じさせる（中略）「敵国」条項を削除する憲章の改正を行うため、国際連合憲章第108条に定める手続きを発動する意向を表明する。（Express its intention to initiate the procedure set out in Article 108 of the Charter of the United Nations to amend the Charter, with prospective effect, by the deletion of the ”enemy State” clause ….）」（外務省訳がないため拙訳）

その特別委員会は結局、招集はされても何の後続アクションも取られず、即ち「決定」を行わなかったという事実があります。

成果文書（総会決議60/1で採択）にしても、「決定」のない、以下の「決意の文言」をそのまま文書として採択しただけです。後続アクションがないことから、そのinactionにより総会決議はその実効性（効力）を失ったと判断されます。他ならぬ決議文において「効力」を生じさせると規定している手続きが取られなかったのですから自明の理です。

刚好在联合国的文件系统里面找了一下（https://t.co/ZajHEdr6aB），大家也可以看看1995年的resolution这个文件：A/RES/50/52。。。

大家可以看到，其中准确的表述是：我们注意到了特别委员会的建议，认识到“敌国条款”已经过时，expresses the intention to initiate the procedure（表达了有意愿启用流程联合国宪章108条的流程）。。。

然后，就没有然后了，虽然倭国一直膈应得很，后续仍多次提起，但成员国们都觉得太麻烦，这个意愿从来没有发生转换为实质，也就是流程从来没有走完过。。。

众所周知，联合国宪章明确是位置最高的多边条约，因为联合国宪章第103条明确规定："本宪章之义务应优先于会员国依任何其他国际协定所负之义务"。这确立了宪章在国际法体系中的优越地位。其条款在未经正式修正或废止前，形式上仍属生效条文。

从这个意义上来说，宪章中的敌国条款从未经过正式修正或删除，也从未公告失效。所以如我们之前所说：从形式上，“敌国条款”仍具有法律效力。。。

有人认为说：倭国已成为联合国成员国，敌国条款的适用对象已经灭失，而不存在“敌国”，条款自然丧失操作空间。

但回顾历史，联合国接纳倭国，是基于倭国承诺“和平主义”这一大前提的。但如果倭国修改和平宪法，拥有核武器或对邻国构成实质军事威胁，就意味着它单方面撕毁了战后安排的契约基础。

既然倭国不再是“爱好和平的国家”，那么它就自动退回到了二战结束时的“敌国”状态。因此，“帝国条款”的“封印”被解除，相关国家（主要是二战战胜国）有权依据这些条款，在不经安理会授权的情况下对其采取行动。

在此意义上，倭国作为一个在联合国宪章中被明文标记为“敌国（Enemy State）”的国家，在彻底清算其军国主义复辟行动（如参拜靖国神社，修改教科书，扩军，拥核）之前，不具备在安理会指控二战战胜国的道德和法律资格。

总之：只要这两个条款还没从宪章里删掉，它们就是悬在倭国头上的政治利剑，也是一个极有用的政治利器，时不时拿着敲打它再合适不过了。。。

特定の文献を意図的に否定しなくとも、後世の創作資料
（いわゆる偽書）は自ずと識別されます。一次資料の伝承体系を
明らかにする過程で、結果として資料の真偽も整理されていく——
それがこの三層分析法の特徴です。

The aim of my research is not to assess so-called “spurious texts,”
but to examine the structures of transmission preserved in primary
sources—such as the Ishinpō, the Shin’ihō, and the Nihon shoki—by
systematically correlating three analytical layers: the textual,
the ritual, and the genealogical. When these layers are compared
with methodological rigor, materials whose chronological frameworks
or lexical strata do not cohere with authenticated sources naturally
fall outside the scope of analysis. Thus, texts composed in later
periods—often labeled as “forgeries”—become identifiable without any
intent to refute them. In clarifying the transmission systems embedded
in genuine primary materials, the question of authenticity is resolved
almost incidentally. This is the distinctive strength of this

皆さんも実際にご覧になれば分かるように、同決議の表現は次のとおりです。「特別委員会の勧告に留意し、『敵国条項』がすでに時代遅れであることを認識し、憲章第108条の改正手続を開始する意向を表明する（expresses the intention to initiate the procedure）」と明記されています。
しかし——その後は何も進みませんでした。倭国側はずっと気にしており、その後も繰り返し提起してきましたが、加盟国の大半は手続が煩雑すぎると考え、その「意向」が実質的行動へ転化することは一度もなく、手続が完了することもありませんでした。
周知のとおり、国連憲章は明文で国際法体系の最上位に位置づけられています。なぜなら、憲章第103条が「本憲章に基づく義務は、加盟国が他のいかなる国際協定によって負う義務に優先する」と規定しているからです。これは国連憲章の優越的地位を確立するものであり、正式な改正または廃止手続が行われない限り、その条項は形式上なお効力を有することを意味します。

この観点からすれば、「敵国条項」はいまだ一度も正式に修正・削除されたことはなく、失効が告示されたこともありません。したがって、先に述べたように、形式的には「敵国条項」は依然として法的効力を保持していることになります。

一般的な見解としては、倭国はすでに国連加盟国となり、敵国条項の対象が消滅した以上、「敵国」はもはや存在せず、条項は実質的に作用し得ないと主張されます。

しかし歴史を振り返れば、国連が倭国を加盟国として受け入れたのは、倭国が「平和主義」を堅持するという大前提があったからです。もし倭国が平和憲法を改正し、核兵器保有へ踏み込み、あるいは周辺国に対して実質的な軍事的脅威を加えることになれば、それは倭国自身が戦後秩序の契約的基盤を一方的に破棄することを意味します。

倭国がもはや「平和愛好国家」でないのなら、第二次世界大戦終結時の「敵国」としての原初的地位に自動的に回帰することになります。そうであれば、「敵国条項」にかけられていた封印が解除され、関係国（主に戦勝国）は安保理の事前承認を要さず、当該条項を根拠として行動する権限を持つことになります。

この意味において、国連憲章に明文で「敵国（Enemy State）」と記載されている倭国は、靖国神社参拝、歴史教科書の改訂、軍備拡張、核武装など、軍国主義的復活とみられる行動を完全に清算しない限り、安保理の場で第二次大戦の戦勝国を非難する道義的・法的資格を有しているとは言えません。

総じて言えば、これら二つの条項が憲章から削除されない限り、それは常に倭国の頭上にぶら下がる「政治的ダモクレスの剣」であり、必要なときに適度に振りかざすことのできる極めて有効な政治的ツールであると言えるでしょう。 November 11, 2025

「準備してからやろう」と思うと、脳が「やった気になる」（ドーパミンの早期放出）。

結果として実行前に満足してしまう。

逆に、「今あるもので始める」人ほど、行動量・経験値が増え、修正も早い。

ポイント：「始める道具」より「始める行動」を重視する。

刚好在联合国的文件系统里面找了一下（https://t.co/ZajHEdr6aB），大家也可以看看1995年的resolution这个文件：A/RES/50/52。。。

大家可以看到，其中准确的表述是：我们注意到了特别委员会的建议，认识到“敌国条款”已经过时，expresses the intention to initiate the procedure（表达了有意愿启用流程联合国宪章108条的流程）。。。

然后，就没有然后了，虽然倭国一直膈应得很，后续仍多次提起，但成员国们都觉得太麻烦，这个意愿从来没有发生转换为实质，也就是流程从来没有走完过。。。

众所周知，联合国宪章明确是位置最高的多边条约，因为联合国宪章第103条明确规定："本宪章之义务应优先于会员国依任何其他国际协定所负之义务"。这确立了宪章在国际法体系中的优越地位。其条款在未经正式修正或废止前，形式上仍属生效条文。

从这个意义上来说，宪章中的敌国条款从未经过正式修正或删除，也从未公告失效。所以如我们之前所说：从形式上，“敌国条款”仍具有法律效力。。。

有人认为说：倭国已成为联合国成员国，敌国条款的适用对象已经灭失，而不存在“敌国”，条款自然丧失操作空间。

但回顾历史，联合国接纳倭国，是基于倭国承诺“和平主义”这一大前提的。但如果倭国修改和平宪法，拥有核武器或对邻国构成实质军事威胁，就意味着它单方面撕毁了战后安排的契约基础。

既然倭国不再是“爱好和平的国家”，那么它就自动退回到了二战结束时的“敌国”状态。因此，第53条和107条的“封印”被解除，相关国家（主要是二战战胜国）有权依据这些条款，在不经安理会授权的情况下对其采取行动。

在此意义上，倭国作为一个在联合国宪章中被明文标记为“敌国（Enemy State）”的国家，在彻底清算其军国主义复辟行动（如参拜靖国神社，修改教科书，扩军，拥核）之前，不具备在安理会指控二战战胜国的道德和法律资格。

总之：只要这两个条款还没从宪章里删掉，它们就是悬在倭国头上的政治利剑，也是一个极有用的政治利器，时不时拿着敲打它再合适不过了。。。
